            "content": "} I (1) . \n(m) \n(n) \n(o) \n(p) \n(l) \n\"State Government\" means the Government of Chhattisgarh\" \n\"Third Party Assessor\" means an assessor of skill levels, not' associated with \ntheVocational Training Provider where the youth being assessed for skill level \nis being trained am.1, so recognized by the State Authority; \n\"Training\" means training imparted to youth for the purposes of skill \ndevelopment; \n\"Vocational Training Provider\" means an individual, an institution, an \nindustry a micro or small enterprise, an association of persons, a Government \nor Non Government Organization or a business having capacity to train, as \nmay be prescribed, registered with the State Authority for training in skills; \n\"Youth\" means a person who is a resident of the State and is not below the age \nof 14 years and !}Ot above the age of 45 years on the date of subm.ission of an \napplication. for skill development. \nNo youth shall be denied opportunity to get skilled in a vocation of choice \nfrom amongst the skills, as notified by the State Authority, subject to \npossessing such eligibility as mentioned in the notification. \n(2) Notwithstanding anything contained in this section or under any provision of \nthis Act, the right to get skilled in a vocation of choice shall be deemed to have \nbeen extinguished, if the youth is not declared successful by the Third Party \nAssessor or fails to satisfactorily complete the relevant training: \n(1) \nProvided that a youth may make an application for developing \nmultiple skills, if a District Authority or the State Authority, as the case may \nbe, has exhausted all eltgible applications for skill development in such skill \n(s) at the time of submission of the application. \nIn exercise of the right to skill development, a youth may make an application, \nto the District Authority or to an officer designated by the State Authority for \nthis purpose in the Performa as prescribed in Schedule of this Act, and the \nDistrict Authority or the officer designated by the State authority shall identify \na Vocational Training Provider and inform the applicant of the same within a \nmaximum period of 90 days from the date of receipt of application: \nProvided that where the Vocational Training Provider, identified \nunder this sub-section, is situated outside the limits of the Block but within the \nlimits of the District and in the opinion of the District Authority the distance \nbetween the Vocational Training Provider and the ordinary residence of the \napplicant is such that commuting to and from the Vocational Training Pro\nvider is beyond the capacity of the applicant then the District Authority shall \n· make such arrangements for providing residential accommodation during the \n. period of training, as may be required on such terms as the District Authority \nmay determinde: \n. Provided further that where the Vocational Tranining Provider is \nsituated outside the limits of the District, the District Authority shall refer the \napplication to the State Authority, which shall thereafter make such arrange\nments as are necessary, in consultation with the District Authority in whose \ndistrict the Vocational Training Provider identified for training is situated. \n(2) An application made to the District Authority under sub-section (I) of this \nsection may be modified by the applicant· where the applicant is found by \nthe District Authority to be suitable for development of a skill other than the \n370 (21.) \nRight of youth to get \nskilled. \nExercising the \nright to skilled \ndevelopment \n\n370 (22) \nTesting and . 5. \ncertification. \nState authority. 6. \nGoverning council. 7. \nih1\"lfti1~ m, ~ 6 ~ 2013 \none applied for, or where the minimum number of applicants are not available \nto commence training in such skill as notified under the regulations for the \npurpose. \nEvery youth enrolled for development of a skill shall be certified by the State Authority \nto possess such skill only after having satisfactorily completed the relevant training by \na Vocational Training Provider and after having been examined and declared sucessful \nby a Third Party Assessor. \nCHAPTER-II \nORGANIZATION AND STRUC.TTTRE OF THE STATE AUTHORITY \nAND DISTRICTAUTHORITY \nThere shalt be a State Authority known by the name of Chhattisgarh State Skill Deve\nlopment Authority in the State of Chhattisgarh to implement the provisions of this Act \nwhich shall be a body corporate having a perpetual succession and a common seal and \nmay by the said name sue or be sued: \nProvided that Lhe Chhattisgarh State Skill Development Mission registered as \na society under the Chhattisgarh Societies Registration Act, 1973 (No: 44 of 1973), \nexisting on the date of commencement of this Act, shall stand dissolved and all assets \nand liabilities of the Chhattisgarh State Skill Development Mission shall be deemed to \nbe the assets and liabilities of the State Authority: \nProvided further that any contractual obligations on the part of the Chhattisgarh \nState Skill Development Mission or accruing to it, includini th0s~ in rP~rP,t of \nemployees, shall deemed to be an obligation of the State Authority or accruing to it, as \nthe case may be. \nThere shall be a Governing Council to exercise supervision and control over the activi\nties of the State Authority and to evolve guidelines on policies to be pursued by it with \nthe following composition :- · \n(a) (I) Chief Minister of the State shall be the Chairperson (Ex-Officio); \n(2) Ministers in-ch<1rge of-\n(i) Technical Education & Manpower Planning, \n(ii) Labour, and . \n(iii) Sports and Youth Welfare Development shall be the \nmembers (Ex-Officio); \n(3) Vice Chaiµerson of Slate Planning Commission shall be the Member \n(Ex-Officio); \n(4) Chief Secretary of the State Government shall be Member (Ex\nOfficio); \n(5) Secretaries to the State Government (by whalever designation called), \nin charge of the .deparlmcnts of Agriculture and Allied Sectors, \nAviation, Energy, Finance, Forests, Health and Medical Education. \nHigher Education, Housing and Environment, Industries, \nInformation Technology and Bio-technology, Internal Security, Media \nand Information, Mining, Panchayat and Rural Development, Public \nWorks, Rural Industries, Scheduled Tribes, Scheduled Castes and \nOther Backward r:lasses Welfare, School Education, Social Welfare, \nTechnical Education and Manpower Planning, Tourism, Urban \nDevelopment, Woman and Child Development and Youih Welfare \nshall be the members (Ex-officio); \n- I \n! \n\n... \n. 8. \n(b) \n(c) \n. m1lti•1~ m, ~ 6 ~ 2013 _ \n(6) · Three chairpersons, by rotation, of District Authorities shall be \nmembers (Ex-officio); and \n(7) Chief E~ecuti've Officer of the State Authority shall be the Member-\nSecretary. \nfoaddition to ~he ex-officio.members, mentioned in clause (a) of this Section, \nfollowing shall also be nominated· by the State Government as membe_rs: \n(I) Three persol)S of eminence, one of whom shall be a woman, with \nbac.kground-in i_ndustry·, trade and commerce; . \n· (2) Three persons of erp.inence, one of whom shall be a woman, with \nbackground in skill development and livelihood progr.ammes; \n(3) Three persons from the State, one of whom shall be a woman, 'who· \nhave contributed substantially to skill development; . , ·' \n(4) Five persons, one· of whom shall be a woman, representing . _ \neducational · institutions, engaged in the field of . technical, \nagricultural, m'edical, vocational and management education; \n(5) . ' >' The · State Authority; shaif have the' followi~g . fu~ctions and responsibilities, \n·., namelf:~ - . · , · \n· (af/ •.: .· It shall; \\\\'hen called upon to do so by the State Government, advise it · \n· · on the skill•development policies and programmes; \n' \n\nI \n(b) At least one month before the beginning of finnancial year, the State \nAuthority shall submit to the State Government, for its approval, the · \nAnnual Skill Development Plan for the ensuing financial .year; \n( c) Once in every five years, the State Authority shall prepare and submit \nto the State Government a perspective plan for skill development in \nthe State having regard to the macro-ecQOomic growth trends, emerg\ning technologies and demand for skilled human resources; \n( d) It shall be the duty of the State Authority, to notify by regul~tions, the \nskill development framework comprising courses and programmes . \nof training, the detailed curriculum, the methodology adopted for \ntesting and for certification, and to modify the same from time to \ntime; \n(e) The State Authority shall have the powers to award certificates in \nrecognition of attainment of skills at various levels by the youth, on \nthe basis of prior knowledge or training provided, by a Vocational \n··Training Provider, and assessed by a Third Party Assessor; \n(t) It shall be the duty of the State Authority, to notify by regulations, the \nprocedure for selection, registration, evaluation, renewal or cancella\ntion of registration of a Vocational Training Provider; \n(g) It shall be the duty of the State Authority, to notify by regulations, the \np~ocedure for selection, registration, evaluation, renewal or cancella\ntion of registration of a Third Party Assessor; \n(h) It shall be the duty of the State Authority to recom[!lend the State \nGovernment, from time to time, one or more certificates or other . \nawards pertaining to skill development, which may _be considered to \nbe equivalent to awards such as degree, diploma, certificates or \neligibility qualifications as are recognized for the purposes of public \nemployment or access to higher education; -\n(i) It shall be the duty of the State Authority, to issue from time to time, \nsuch directions and guidelines to the District Authority for the \neffective implementation of the Act, as it may deem necessary; \nG) Subject to availability of funds at its disposal, the State Authority \nmay take up such iother activities not included in the Annual Skill \nDevelopment Plan1, which in its opinion, are necessary for the pur\nposes of this Act: \n- :,~ l ., \nProvided that where the requirement of funds is, or is likely \nto be, liability on the State exchequer, no activity other than those \ncontained in the Annual Skill Development Plan shall be taken up,· \nexcept with the prior approval of the State Government; \n(k) Subject to the financial Provisions, the State Authority shall have the \npow.ers to employ on contract or otherwise, such number of persons \nto assist the Chief Executive Officer necessary to car~y out its func\ntions, and every such employment shall be subject to the provisions \nof the Chhattisgarh Lok Sewa (Anusuchit ,Jatiyon, Anusuchit \nJanjatiyon Aur Anya Pichhade Vargon Ke Liye Arakshan) Adhiniyam, \n1994 (No. 21 of 1994 ), as amended from time to ti me; \n,.. ,, '; '. ~ :,·. • ·.,;;..1 !,·· w i< •• \n.             "content": "(2) \n\\ \n(]) The State Authority shall have the powers to deal with any movable \nproperty be:longing to, or vested in it, in such manner as it-may deem \nf~t for advariyement -of _its objects; \n(m) The State Aµthority s~all have the powers to receive grants or loa~s, \nas the case ma:y be, from the State Government; \n(n) The State Authority shall ha\\le the powers to receive gifts, donations, \nbequests, benefactions or transfer of movable or immovable proper\nties from testators, donors or transferors, as the case may be, for pur\nposes not inconsistent with the provisions of this Act; \n(o) The State Authority shall have the powers to collaborate with institu0 \ntions of national or international repute engaged in skill development, \nfor furthering the purposes of this Act; , \n(p) Subject to the provisions of this Act, the State Authority shall have \nthe powers to do all such things, which are not specifically mentioned \nin the foregoing provisions of this Section, , and which may b_e \nnecessary for carrying out the purp~es of this Act; and \n(q) · The State Authority shall perform such other functions, not being \ninconsistent with the purposes of this Act, as assigned to it by the \nState Government.· \nNotwithstanding anything containe<;J/4n sub-section (1) of this Section, theS~ate \nAuthority shall not dispose nff, irt any manner, any imm(wahle prop1my \nwithout th~ prior approval of the State Government. \n1 \n· \nThe Governing Council shall meet at least once in a year and shall have the folloWing \nfunctions and responsibilities, namely :....:._ · \n(a) To provide policy directions to the Executive Committee or the Chief. \nExecutive Officer, as the case may be, for_ the implementation of the \nProvisions of this Act and regulations made thereunder;· \n(b) To advise the State Government on policies dealing with skill development;· \n(c) To appro_ve the fJve-year perspective plan for ~kill development in the State; \n(d) To approve the.Annual Skill Development Plan proposed by the Executive \nCo1pmittee 1 with such modifications as it may deem fit; \n(e) To appro/e notification of regulations made under Section 11 of this Act: or \nmodifications thereof;,· . · \n(t) \n(h) \nTo approve the Annual Report and the Annual Financial Accounts of the State \nAuthority; · \nTo delegate, to such ext~nt, any of its powers to the Executi_ve Committee and \nto_ authorize it. to take.·such decisions on its behal~, as may be necessary, for \n. effectiv_ely c_arrying out the purposes of this Act; and \n·' ··' \nTo exerc_ise:such other powers not specified above, a_s 'may be necessary to \ncarry out the purposes of this Act, which do not require the prior approval of \nthe State 'Government. \nThe Executive Committee shall meet at least once in every three months, and shall have \nthe following functions and resposibilities, namely :-\n. (a) To:review-and .monitor the implementation of the provisions of this Act and \nregulations made thereunder ; \n\n. \n· (b) To approve the five-year perspective· plan for skill development in the State \nfor the consideration of the Govern!ng Coucil; \n(c) · To approve the Annual Skill Development Plan, submitted· by the Chief \nExceutive Officer, and to recommend the same for the consider:ation of the \nGoverning Council, at least two months before the beginning of the financial \nyear next; . \n' (d) To make, adopt, amend, vary or rescind, from time to time and with the \n(e) \n(t) \n(g) \n\\ \n\\ \ni \\ \n\\ \n\\ \n\\. \n(h) \n'. \n(i) \n. (i) \n.             "content": "(I) This Act may be called the Chhattisgarh Right ofYouth to Sk ill Deve lopment \n(Amendmen t) Act, 20 15. \n(2) It sha ll come into force from the date of its publication in the Official Gazette. \nAfter clause (g) of Section 2 of the Chhattisgarh Right of Youth to SK ill Development \nAct, 2013 (No. 17of2013), (hereinafter referred to as the Principal Act), the following \nshall be inserte d, name ly:-\n\"(gg) \"Livelihood Co llege Society\" means the society registered under the \nChhattisgarh Soc iety Registrikaran Adh iniyam, 1973 (No. 44 of 1973), \nvide registrati on No. 4808 , dated 14th July, 2014 , and shall include its \nsuccess ors;\" \nIn Section 7 of the Principal Act-\n(i) For sub-clause (5) of clau se (a), the following shall be substituted, namel y :-\n\"(5) Secretari es to the State Government, by whateve r designation called, \nin-charge of the Departments of Agriculture, Animal Husband ry, \nEnergy, Finance , Forest , Public Health and Family Welfare , Medical \n\nEducation, Higher Education, Commerce and Industry, Electronics \nand Information Technolog y, Labour , Mining , Panchayat and Rural \nDevelopment, Rural Industries , Scheduled Tribes and Scheduled Castes \nDevelopment, Schoo l Education, Social Welfare, Technical \nEducation, Manpower Plann ing, Tourism, Urban Administration, and \nWoman and Chi ld Development , shal l be members (ex-officio) ;\" \n(ii) After sub-clause (5) of clause (a), the following shall be inserted , namely:-\n\"(SA) Chief Execut ive Officer of the Livelihood College Society shall be \na member (ex-officio) ;\" \n(iii) For sub-clause ( 1) of clause (b ), the following shall be substituted , namely :-\n\"(l) Four persons of eminence with background in industry, trade and \ncommerce, skill deve lopment and livelihood programme s, among \nwhom: \none shall be a woman , and \none sha ll be from the State;\" \n(iv) Sub-clause (2) and (3) of clause (b) shall stand omitted. \n(v) For clause (c), the following shall be substituted , namely :-\n\"(c) Two members of the State Legislative Assem bly nominated by the \nSpeaker shall be members (ex-officio).\" \n458 (3)",
