(d) In sub-section (2) of Section 4 of\n\t\t\t\t\tthe Bombay Tenancy Act referred to therein- (1) for the words\n\t\t\t\t\tand figures \"the 8th November, 1946\" the words and\n\t\t\t\t\tfigures \"the 11th day of August, 1948\" shall be\n\t\t\t\t\tsubstituted; (2) For the words and figures \"31st May,\n\t\t\t\t\t1947\" occurring in sub-clause (b) (i), the words and\n\t\t\t\t\tfigures \"31st May, 1949\" shall be substituted. (ii) in clause (5) (a) for the\n\t\t\t\t\tfigures, letters and word \"30,h January, 1940\"\n\t\t\t\t\twherever they occur, the figures, letters and word \"lsl\n\t\t\t\t\tJanuary, 1948\" shall be substituted; (b) for the words\n\t\t\t\t\t\"the date of the coming into operation of this Act or the\n\t\t\t\t\testablishment of the Board concerned under the repealed Act,\n\t\t\t\t\t\"wherever they occur the words, figures and letters \"the\n\t\t\t\t\t15,h day of September, 1948\" shall be substituted. (2)\n\t\t\t\t\tIn Section 4, for subsection (1) the following shall be\n\t\t\t\t\tsubstitute, namely:-\"(1) Any debtor ordinarily residing in\n\t\t\t\t\tany local area or his creditor may make an application on or\n\t\t\t\t\tbefore the 15th June, 1949 to the Court for the adjustment of\n\t\t\t\t\this debts\". (3) In Section 7, for the figures, letters\n\t\t\t\t\tand word \"1st January, 1938\" the figures, letters and\n\t\t\t\t\tword \"1st January, 1948\" shall be substituted. (4)\n\t\t\t\t\tIn Section 22, the following proviso shall be added at the end,\n\t\t\t\t\tnamely: \"Provided further that where any amount due to a\n\t\t\t\t\tcreditor is determined by a competent tribunal or authority\n\t\t\t\t\tunder any law in force in any of the States relating to the\n\t\t\t\t\tconciliation or adjustment of the debts of agriculturists\n\t\t\t\t\tcorresponding to this Act, the amount so determined shall be\n\t\t\t\t\tbinding on the parties.\" (5) In Section 23, in the\n\t\t\t\t\tproviso, after the figures \"1879\" the words \"or\n\t\t\t\t\tany enactment corresponding thereto\" shall be inserted. (6)\n\t\t\t\t\tIn Section 24, subsection (2), for the figures, letters and word\n\t\t\t\t\t\"1st August 1947\" the figures, letters and word \"16th\n\t\t\t\t\tJune, 1949\" shall be substituted. (7) In Section\n\t\t\t\t\t25,- (a) in clause (i), the words and figures \"or by a\n\t\t\t\t\tBoard established under Section 4 of the repealed Act\"\n\t\t\t\t\tshall be deleted; (b) in clause (ii) for the figures, letters\n\t\t\t\t\tand words \"15,h February, 1939\" the figures, letters\n\t\t\t\t\tand word \"l8th January, 1948\" shall be\n\t\t\t\t\tsubstituted. (8) In Section 32, subsection (2)- (i) for\n\t\t\t\t\tclause (c) the following clause shall be substituted\n\t\t\t\t\tnamely:- \"(c) loans given by resource societies or by\n\t\t\t\t\tpersons authorised to advance loans under Section 54 for the\n\t\t\t\t\tfinancing of crops or for seasonal finance\"; (ii) in the\n\t\t\t\t\tExplanation the words \"under the repealed Act\" and the\n\t\t\t\t\twords \"under this Act\" shall be deleted. (9) In\n\t\t\t\t\tSection 56 for the words \"date of the coming into operation\n\t\t\t\t\tof this Act\" the figures, letters and word \"15th June,\n\t\t\t\t\t1949\" and for the words and figures \"the Dckkhan\n\t\t\t\t\tAgriculturist Relief Act, 1879\" the words and figures \"any\n\t\t\t\t\tenactment corresponding to the Dekkhan Agriculturists' Relief\n\t\t\t\t\tAct, 1879, in force in any of the States\" shall be\n\t\t\t\t\tsubstituted. (10) In Section 56, in subsection (1)- (i)\n\t\t\t\t\tfor the words and figures \"the Dekkhan Agriculturists'\n\t\t\t\t\tRelief Act, 1879, by the Bombay Agricultural Debtors Relief Act,\n\t\t\t\t\t1939, the first mentioned Act\", the words and figures \"any\n\t\t\t\t\tenactment corresponding to the Dekkhan Agriculturists' Relief\n\t\t\t\t\tAct, 1879, in force in any of the States, such enactment\"\n\t\t\t\t\tshall be substituted; (ii) the words and brackets \"with\n\t\t\t\t\teffect from the date of the coming into operation of this Act\n\t\t\t\t\t(hereinafter in this section referred to as the said date\")\n\t\t\t\t\tshall be deleted; (iii) for the words \"for the period\n\t\t\t\t\tof three years from the said date\" the words, figures and\n\t\t\t\t\tletters \"up to the 26th day of May, 1950\" shall be\n\t\t\t\t\tsubstituted; (iv) for the first proviso the following shall be\n\t\t\t\t\tsubstituted, namely:- \"Provided that any proceeding in\n\t\t\t\t\tor out of any suit instituted on or before the 26th May, 1950\n\t\t\t\t\tshall be continued and disposed of after the said date, as if\n\t\t\t\t\tthe enactment corresponding to the Dekkhan Agriculturists'\n\t\t\t\t\tRelief Act, 1879, had continued in force after the said date.\"\nThe Bombay Agricultural Debtors Relief Act,\n\t\t\t\t\t1947 (Bombay XXVIII of 1947).\nKolhapur\n(1) In Section 2,- (1) in clause (2),\n\t\t\t\t\t\"Cooperative Society\" shall mean a society registered\n\t\t\t\t\tunder any of the provisions corresponding to those contained in\n\t\t\t\t\tthe Bombay Co-operative Societies Act, 1925, or a society\n\t\t\t\t\tregistered under the said Act; (a) for the figures, letters\n\t\t\t\t\tand word \"30th January, 1940\" wherever they occur, the\n\t\t\t\t\tfigures, letters and word \"1sl January, 1949\" shall be\n\t\t\t\t\tsubstituted; (b) for the words \"the date of the coming\n\t\t\t\t\tinto operation of this Act or of the establishment of the Board\n\t\t\t\t\tconcerned under the repealed Act\", wherever they occur, the\n\t\t\t\t\twords, figures and letters \"the 1st May, 1949\" shall\n\t\t\t\t\tbe substituted. (ii) in clause (5)- (2) In Section 4, for\n\t\t\t\t\tsubsection (1) the following shall be substituted, namely:- \"(1)\n\t\t\t\t\tAny debtor ordinarily residing in any local area or his creditor\n\t\t\t\t\tmay make an application before the 31st October, 1949 to the\n\t\t\t\t\tCourt for the adjustment of his debts: Provided that any\n\t\t\t\t\tdebtor ordinarily residing in any of the villages of Mososhi,\n\t\t\t\t\tSoliwade, Angale and Mosam forming part of the Rajapur Taluka of\n\t\t\t\t\tthe Ratnagiri District or any creditor of such debtor may make\n\t\t\t\t\tan application on or before the 31st August, 1950 to the Court\n\t\t\t\t\tfor the adjustment of his debts.\" (3) In Section 7, for\n\t\t\t\t\tthe figures, letters and word \"1st January, 1938\" the\n\t\t\t\t\tfigures, letters and word \"1st January, 1949\" shall be\n\t\t\t\t\tsubstituted. (4) In Section 22, the following proviso shall\n\t\t\t\t\tbe added at the end, namely:- \"Provided further that where\n\t\t\t\t\tany amount due to a creditor is determined by a competent\n\t\t\t\t\ttribunal or authority under any law in force in the Kolhapur\n\t\t\t\t\tState relating to the conciliation or adjustment of the debts of\n\t\t\t\t\tthe agriculturists corresponding to this Act, the amount so\n\t\t\t\t\tdetermined shall be binding on the parties\". (5) In\n\t\t\t\t\tSection 23, in the proviso, after the figures \"1879\"\n\t\t\t\t\tthe words \"or any enactment corresponding thereto\"\n\t\t\t\t\tshall be inserted. (6) In Section 24, in subsection (2),- (i)\n\t\t\t\t\tfor the figures, letters and word \"1st August, 1947\"\n\t\t\t\t\tthe figures, letters and word \"31st October, 1949\"\n\t\t\t\t\tshall be substituted; (ii) after the words \"transfer in the\n\t\t\t\t\tnature of a mortgage\" the following proviso shall be\n\t\t\t\t\tinserted- \"Provided that any agricultural labourer\n\t\t\t\t\tordinarily residing in any of the villages of Mososhi, Soliwade,\n\t\t\t\t\tAngale and Mosam forming part of the Rajapur Taluka of the\n\t\t\t\t\tRatnagiri District may make such application on or before the\n\t\t\t\t\t31s1 August, 1950\". (iii) before the words \"On\n\t\t\t\t\thearing the application\" the brackets and figure \"(3)\"\n\t\t\t\t\tshall be inserted. (7) In Section 25,- (i) in clause (i),\n\t\t\t\t\tthe words and figure \"or by a Board established under\n\t\t\t\t\tSection 4 of the repealed Act\" shall be deleted; (ii) in\n\t\t\t\t\tclause (ii), for the figures, letters and words \"15th\n\t\t\t\t\tFebruary,, 1939\", the figures, letters and words \"1st\n\t\t\t\t\tJanuary, 1949\" shall be substituted. (8) In Section 32,\n\t\t\t\t\tin subsection (2),- (i) for clause (c), the following clause\n\t\t\t\t\tshall be substituted, mainly:- \"(c) loans given by\n\t\t\t\t\tresource societies or by persons authorised to advance loans\n\t\t\t\t\tunder Section 54 for the financing of crops or for seasonal\n\t\t\t\t\tfinance,\"; (ii) in the Explanation the words \"under\n\t\t\t\t\tthe repealed Act\" and the words \"under this Act\"\n\t\t\t\t\tshall be deleted. (9) In Section 56, in subsection (1),- (i)\n\t\t\t\t\tfor the words and figures \"the Dekkhan Agriculturists'\n\t\t\t\t\tRelief Act, 1879, by the Bombay Agricultural Debtors Relief Act,\n\t\t\t\t\t1939, the first mentioned Act\" the words \"any\n\t\t\t\t\tenactment corresponding to the Dekkhan Agriculturists' Relief\n\t\t\t\t\tAct, 1879, in force in the Kolhapur State, such enactment\",\n\t\t\t\t\tshall be substituted; (ii) the words and brackets \"with\n\t\t\t\t\teffect from the date of the coming into operation of this Act\n\t\t\t\t\t(hereinafter in this section referred to as the said date)\"\n\t\t\t\t\tshall be deleted; (iii) for the words \"for a period of\n\t\t\t\t\tthree years from the said date] the words, figures and letters\n\t\t\t\t\t\"up to the 26th day of May, 1950\" shall be\n\t\t\t\t\tsubstituted; (iv) for the first proviso the following proviso\n\t\t\t\t\tshall be substituted, namely:- \"Provided that any\n\t\t\t\t\tproceeding in or out of any suit instituted on or before the\n\t\t\t\t\t26th May, 1950 shall be continued and disposed of after the said\n\t\t\t\t\tdate, as if the enactment corresponding to the Dekkhan\n\t\t\t\t\tAgriculturists' Relief Act, 1879, had continued in force after\n\t\t\t\t\tthe said date\".\nThe Bombay Tenancy and Agricultural Lands Act,\n\t\t\t\t\t1948 (Bombay LXVII of 1948).\nBaroda and Danta\nIn column 4 of the Schedule annexed to the\n\t\t\t\t\tAct,- (a) in Section 3-A of the Bombay Tenancy Act referred\n\t\t\t\t\tto therein for the words and figures \"the eighth day of\n\t\t\t\t\tNovember, 1947\" the words and figures \"the first\n\t\t\t\t\tAugust, 1950\" shall be substituted; (b) in the proviso\n\t\t\t\t\tto subsection (1) of Section 4 of the Bombay Tenancy Act\n\t\t\t\t\treferred to therein, reference to \"Section 9 of the Bombay\n\t\t\t\t\tSmall Holders Relief Act, 1938\" shall be read as reference\n\t\t\t\t\tto \"any enactment corresponding to Section 9 of the Bombay\n\t\t\t\t\tSmall Holders Relief Act, 1938, if any, in the State\"; (c)\n\t\t\t\t\tin the proviso to subsection (1) of Section 4 of the Bombay\n\t\t\t\t\tTenancy Act referred to therein, for the words and figures \"the\n\t\t\t\t\teighth day of November, 1946\" the words and figures \"the\n\t\t\t\t\tfirst day of August, 1949\" shall be substituted; (d) in\n\t\t\t\t\tsub-section (2) of Section 4 of the Bombay Tenancy Act referred\n\t\t\t\t\tto therein- (1) for the words and figures \"the eighth\n\t\t\t\t\tNovember, 1946\" the words and figures \"the first\n\t\t\t\t\tAugust, 1949\" shall be substituted, (2) for the words\n\t\t\t\t\tand figures \"31st day of May, 1947\" occurring in\n\t\t\t\t\tsub-clause (b) (i) the words and figures \"31st day of May,\n\t\t\t\t\t1950\" shall be substituted, (3) for the words and\n\t\t\t\t\tfigures \"1st day of June, 1947\" occurring in\n\t\t\t\t\tsub-clause (b) (ii), the words and figures \"1st day of\n\t\t\t\t\tJune, 1950\" shall be substituted.\nThe Bombay Agricultural Debtors Relief Act,\n\t\t\t\t\t1947 (Bombay XXVIII of 1947).\nBaroda and Danta\n(1) In Section 2- (1) in clause (2),\n\t\t\t\t\t\"Cooperative Society\" shall mean a society registered\n\t\t\t\t\tunder any of the provisions corresponding to those contained in\n\t\t\t\t\tthe Bombay Co-operative Societies Act, 1925, or a society\n\t\t\t\t\tregistered under the said Act; (ii) in clause (5)- (a) for\n\t\t\t\t\tthe figures letters and word \"30lh January, 1940\"\n\t\t\t\t\twherever they occur the figures, letters and word \"1st\n\t\t\t\t\tJanuary, 1949\" shall be substituted; (b) the words \"or\n\t\t\t\t\tthe establishment of the Board concerned under the repealed Act\"\n\t\t\t\t\twherever they occur shall be deleted. (2) In Section 4 for\n\t\t\t\t\tsubsection (1), the following shall be substituted,\n\t\t\t\t\tnamely:- \"(1) Any debtor ordinarily residing in any\n\t\t\t\t\tlocal area or his creditor may make an application on or before\n\t\t\t\t\tthe 31st January, 1950 to the Court for adjustment of his\n\t\t\t\t\tdebts\". (3) In Section 7 for the figures, letters and\n\t\t\t\t\tword \"1st January 1938\", the figures, letters and word\n\t\t\t\t\t\"1st January, 1949\" shall be substituted. (4) In\n\t\t\t\t\tSection 22 the following proviso shall be added at the end\n\t\t\t\t\tnamely:- \"Provided further that where any amount due to\n\t\t\t\t\ta creditor is determined by a competent tribunal or authority\n\t\t\t\t\tunder any law in force in the Baroda or Danta State relating to\n\t\t\t\t\tthe conciliation or adjustment of the debts of the\n\t\t\t\t\tagriculturists corresponding to this Act, the amount so\n\t\t\t\t\tdetermined shall be binding on the parlies.\" (5) In\n\t\t\t\t\tSection 23 in the proviso after the figures \"1879\" the\n\t\t\t\t\twords \"or any enactment corresponding thereto\" shall\n\t\t\t\t\tbe inserted. (6) In Section 24 in subsection (2), for the\n\t\t\t\t\tfigures, letters and word \"1st August, 1947\" the\n\t\t\t\t\tfigures and word \"1st February, 1950\" shall be\n\t\t\t\t\tsubstituted. (7) In Section 25- (i) in clause (i), the\n\t\t\t\t\twords and figures \"or by a Board established under Section\n\t\t\t\t\t4 of the repealed Act\" shall be deleted, (ii) in clause\n\t\t\t\t\t(ii), for the figures, letters and words \"15th February,\n\t\t\t\t\t1939\" the figures, letters and words \"1st January,\n\t\t\t\t\t1949\" shall be substituted. (8) In Section 32, in\n\t\t\t\t\tsubsection (2)- (i) for clause (c), the following clause\n\t\t\t\t\tshall be substituted, namely :- \"(c) loans given by\n\t\t\t\t\tresource societies or by persons authorised to advance loans\n\t\t\t\t\tunder Section 54 for the financing of crops or for seasonal\n\t\t\t\t\tfinance,\"; (ii) in the Explanation, the words \"under\n\t\t\t\t\tthe repealed Act\" and the words \"under this Act;\"\n\t\t\t\t\tshall be deleted. (9) In Section 56, in subsection (1)- (i)\n\t\t\t\t\tfor the words and figures \"the Dekkhan Agriculturists\n\t\t\t\t\tRelief Act, 1879, by the Bombay Agricultural Debtors' Relief\n\t\t\t\t\tAct, 1939, the first mentioned Act\", the words \"any\n\t\t\t\t\tenactment corresponding to the Dekkhan Agriculturists' Relief\n\t\t\t\t\tAct, 1879, in force in the State\" shall be\n\t\t\t\t\tsubstituted; (ii) the words and brackets \"with effect\n\t\t\t\t\tfrom the date of coming into operation of this Act (hereinafter\n\t\t\t\t\tin this section referred to as the said date )\" shall be\n\t\t\t\t\tdeleted; (iii) for the words \"for a period of three\n\t\t\t\t\tyears from the said date\" the words, figures and letters\n\t\t\t\t\t\"up to the 26th day of May, 1950\" shall be\n\t\t\t\t\tsubstituted; (iv) for the first proviso, the following\n\t\t\t\t\tproviso shall be substituted, namely :- \"Provided that\n\t\t\t\t\tany proceeding in or out of any suit instituted on or before the\n\t\t\t\t\t26th May, 1950 shall be continued and disposed of after the said\n\t\t\t\t\tdate, as if the enactment corresponding to the Dekkhan\n\t\t\t\t\tAgriculturists' Relief Act, 1879, had continued in force after\n\t\t\t\t\tthe said date.\"\nThe Bombay Rents, Hotel and Lodging Home Rates\n\t\t\t\t\tControl Act, 1947 (Bombay LVII of 1947).\nBaroda\n(1) For clause (10) of Section 5 the following\n\t\t\t\t\tshall be substituted:- \"(10) `specified date' means- (a)\n\t\t\t\t\tin the case of any premises let for the purpose of residence,\n\t\t\t\t\tthe first January, 1944. (b) in the case of any premises let\n\t\t\t\t\tfor non-residential purposes, the first day of January\n\t\t\t\t\t1944. (10-A) `Standard rent' in relation to any premises let\n\t\t\t\t\tfor the purpose of residence or for non-residential purpose\n\t\t\t\t\tmeans- (a) where the standard rent is fixed by the Controller\n\t\t\t\t\tunder the House Rent Control Order, 1947, made by the Baroda\n\t\t\t\t\tGovernment, such standard rent, or (b) Where the standard\n\t\t\t\t\trent is not so fixed, subject to the-provisions of Section 11\n\t\t\t\t\t- (i) the rent at which the premises were let on the\n\t\t\t\t\tspecified date, or (ii) where they were not let on the\n\t\t\t\t\tspecified date the rent at which they were last let before that\n\t\t\t\t\tdate, or (iii) where they were first let after the specified\n\t\t\t\t\tdate, the rent at which they were first let, or (iv) in any\n\t\t\t\t\tof these cases specified in Section 11, the rent fixed by the\n\t\t\t\t\tCourt: Provided that an increase in rent made in operation\n\t\t\t\t\timmediately before the 30,h day of July, 1949, in accordance\n\t\t\t\t\twith the provision of the said House Rent Control Order, 1947,\n\t\t\t\t\tshall be deemed to be included in the standard rent;\". Power of Government\n\t\t\t\t\tto withdraw exemption for concession granted in respect of\n\t\t\t\t\ttaxes. - The State Government may at any time by order in\n\t\t\t\t\twriting withdraw any exemption from, or concession in respect\n\t\t\t\t\tof, any tax granted to any person by the Government of the\n\t\t\t\t\tformer Baroda State by an order issued under the `A' Class\n\t\t\t\t\tMunicipalities Act (Baroda Act No. XII of 1949).\" [(2)] In Section 91-A- (i) after sub-section (2), the following\n\t\t\t\t\tshall be inserted, namely:- \"(2A) It shall be the duty\n\t\t\t\t\tof every Municipality to maintain every regular line of the\n\t\t\t\t\tpublic street prescribed or sanctioned by the Government of the\n\t\t\t\t\tformer Baroda State at any time prior to the 301h day of July,\n\t\t\t\t\t1949: Provided that the Municipality may alter or cancel any\n\t\t\t\t\tsuch regular line if having regard to the needs of traffic- (a)\n\t\t\t\t\tit was before the aforesaid date classified by the Municipality,\n\t\t\t\t\twith the sanction of the Government of the former Baroda State,\n\t\t\t\t\tas unimportant, or (b) it is so classified by the\n\t\t\t\t\tMunicipality with the sanction of the State Government within\n\t\t\t\t\ttwo years from the commencement of the Bombay Merged States\n\t\t\t\t\t(Laws) (Second Amendment) Act, 1951 (Bombay XXXII of\n\t\t\t\t\t1951).\" (ii) in sub-section (3), the following shall be\n\t\t\t\t\tadded at the end, namely:- \"Explanation. -For the\n\t\t\t\t\tpurposes of this section, the regular line of the public street'\n\t\t\t\t\tshall include a regular line of public street prescribed or\n\t\t\t\t\tsanctioned by the Government of the former Baroda State at any\n\t\t\t\t\ttime prior to the 30th July, 1949.\"] [(3)] After\n\t\t\t\t\tSection 180 of the Bombay District Municipal Act, 1901 (Bombay\n\t\t\t\t\tIll of 1901), the following section shall be inserted, namely:- \"180-A. (1) Notwithstanding anything contained\n\t\t\t\t\tin the foregoing provisions of this Act, such rules, by-laws,\n\t\t\t\t\torders made, issued or sanctioned by or in respect of any of the\n\t\t\t\t\tMunicipalities whether constituted under the A Class\n\t\t\t\t\tMunicipalities Act (Baroda No, XII of 1949) or the B Class\n\t\t\t\t\tMunicipalities Act (Baroda No. XIV of 1949) of the former Baroda\n\t\t\t\t\tState (hereinafter called \"the said Municipalities\"\n\t\t\t\t\tand \"the said Baroda Municipalities Acts\"\n\t\t\t\t\trespectively) as were in force immediately before the 30lh day\n\t\t\t\t\tof July, 1949 under the said Baroda Municipalities Acts, shall\n\t\t\t\t\tin so far as they are consistent with the provisions of the\n\t\t\t\t\tBombay District Municipal Act, 1901 (Bombay Ill of 1901), shall\n\t\t\t\t\tbe deemed to have been made, issued or sanctioned by or in\n\t\t\t\t\trespect of the said Municipalities under the appropriate\n\t\t\t\t\tprovisions of the said Act on the said date and continue in\n\t\t\t\t\tforce until altered, repealed or amended by a competent\n\t\t\t\t\tauthority. (2) All references to the Baroda Government or to\n\t\t\t\t\tany officer of the Baroda Government in any such rules, by-laws\n\t\t\t\t\tor orders shall be construed as references to the Government of\n\t\t\t\t\tBombay or the corresponding officer of the Government of Bombay,\n\t\t\t\t\tas the case may be; and all licenses, permits or permission\n\t\t\t\t\tissued or given under any such rules, bylaws or orders shall\n\t\t\t\t\talso continue in force until superseded or modified by a\n\t\t\t\t\tcompetent authority.\"\n\"74A. Power of Government\n\t\t\t\t\tto withdraw exemption for concession granted in respect of\n\t\t\t\t\ttaxes.\n\"180-A.\n[The Bombay District Municipal Boroughs Act,\n\t\t\t\t\t1925 (Bombay XVIII of 1925).]\nBaroda\n[(A-1) After Section 4, the following section\n\t\t\t\t\tshall be inserted, namely:-] \"4-A. Inclusion of\n\t\t\t\t\tcertain industrial areas in Baroda Municipal area from 1st\n\t\t\t\t\tAugust, 1949. - (1) Notwithstanding anything contained in\n\t\t\t\t\tthis Act or the Bombay District Municipal Act, 1901 (Bombay III\n\t\t\t\t\tof 1901) (hereinafter referred to as the District Municipal Act)\n\t\t\t\t\tthe area known as the Industrial Zone to the north of the\n\t\t\t\t\tAlembic Chemical Works Co. Limited, and the area covered by the\n\t\t\t\t\tsaid Chemical Works, and described in Schedule I-A, hereinafter\n\t\t\t\t\treferred to as the said areas, shall be `deemed to have been\n\t\t\t\t\tincluded within the limits of the former Baroda Municipal\n\t\t\t\t\tDistrict from the 1st day of August, 1949 to the 30lh day of\n\t\t\t\t\tApril, 1950 (both inclusive) and within the limits of the Baroda\n\t\t\t\t\tMunicipal Borough with effect from the 1st day of May, 1950. (2)\n\t\t\t\t\tAny appointment, notification, notice, order, scheme, licence\n\t\t\t\t\tpermission, rule, by-law or form or any tax made, issued or\n\t\t\t\t\timposed or purported to have been made issued or imposed and\n\t\t\t\t\tanything done or purported to have been done in respect of any\n\t\t\t\t\tsuch appointment, notification, notice, order, scheme, licence,\n\t\t\t\t\tpermission, rule, by-law, form or tax, under the District\n\t\t\t\t\tMunicipal Act or this act, in respect of the said areas, in so\n\t\t\t\t\tfar as such appointment, notification, notice, order, scheme,\n\t\t\t\t\tlicence, permission, rule, by-law, form, tax or thing is not\n\t\t\t\t\tinconsistent with the provisions of the District Municipal Act\n\t\t\t\t\tor this Act, as the case may be, shall be legal and valid and\n\t\t\t\t\tshall be deemed to have been legal and valid in respect of the\n\t\t\t\t\tsaid areas from the dates on which it was made, issued, imposed\n\t\t\t\t\tor done, as the case may be and shall continue in force unless\n\t\t\t\t\tand until it is superseded by any other appointment,\n\t\t\t\t\tnotification, notice, order, scheme, licence, permission, rule,\n\t\t\t\t\tby-law, form or tax made, issued or imposed or anything done\n\t\t\t\t\tunder this Act.\" [(A-2) After Schedule I, the following\n\t\t\t\t\tSchedule shall be inserted, namely:- \"Schedule\n\t\t\t\t\tI-A. Beginning from the East-South corner of Survey No. 104\n\t\t\t\t\tof the Subhanpura village and going along the northern boundary\n\t\t\t\t\tof Survey Nos. 105, 102, 106, 149, 150, 156/1 and 157, then\n\t\t\t\t\tcrossing the road and starting from the South-West corner of\n\t\t\t\t\tSurvey No. 94, going in North along the village site boundaries\n\t\t\t\t\tof the village Subhanpura up to Survey No. 92 and going through\n\t\t\t\t\tSurvey Nos. 1107, 1108, 1109, 1116, 1117, 1118, 1123, 1168, 22,\n\t\t\t\t\t21, 17 and 18 of the Gorwa village then turning to East and\n\t\t\t\t\tgoing through Survey Nos. 19 and 20, then crossing the road\n\t\t\t\t\tgoing along the Gorwa village site boundary up to South-East\n\t\t\t\t\tcorner then crossing the road and turning North and going in the\n\t\t\t\t\tNorth along the western boundary of the road passing by the\n\t\t\t\t\tGorwa village site, then passing through Survey Nos. 1, 2, 626,\n\t\t\t\t\t627, 628 and 624 up to the Northern end of the Industrial area,\n\t\t\t\t\tthen turning East, and coming up to the North-West corner of\n\t\t\t\t\tSurvey No. 624 in the Industrial area and then walking along the\n\t\t\t\t\tnorthern limit of the road and then passing through Survey Nos.\n\t\t\t\t\t624 and 628, crossing the road and passing through Survey Nos.\n\t\t\t\t\t700, 699, 698, 694, 695, 760, 761, 759, 758, 766, 767, 754 and\n\t\t\t\t\t768 up to the North-East corner of the Industrial zone in Survey\n\t\t\t\t\tNo. 769, then turning South and going along the eastern boundary\n\t\t\t\t\tof Survey Nos. 753, 752, 751, 1014/1, 1013, 1011/1, 1010/1,\n\t\t\t\t\t1009, 1007/1-2, 1006, 1005/1-2, 1004, 1003/1, 1001, 1000 and 999\n\t\t\t\t\tand then walking along the Railway siding of the Alembic\n\t\t\t\t\tChemical Works upto its junction with the main lines, then\n\t\t\t\t\tturning to the West and reaching the southern boundary of Survey\n\t\t\t\t\tNo. 984 of Gorwa village and walking along the eastern boundary\n\t\t\t\t\tof Survey Nos. 627, 626, 625 and 624 up to its South-East corner\n\t\t\t\t\tand then turning West and walking along its southern boundary\n\t\t\t\t\tand reaching South-West corner of Survey No. 623 and then\n\t\t\t\t\tturning towards North along the boundaries of Survey Nos. 623\n\t\t\t\t\tand 622 and then crossing the road and reaching the South-East\n\t\t\t\t\tcorner of Survey No. 1084 of Gorwa village and turning to the\n\t\t\t\t\tWest along the southern boundaries of Survey Nos. 1084, 1085,\n\t\t\t\t\t1088, 1091 and 1092 reaching to the main road of the Industrial\n\t\t\t\t\tzone.\"] [(1) After Section 103, the following section\n\t\t\t\t\tshall be inserted, namely:- \"(103A) Power of\n\t\t\t\t\tGovernment to withdraw exemption or concession granted in\n\t\t\t\t\trespect of taxes. - The State Government may at any time by\n\t\t\t\t\torder in writing withdraw any exemption from, or any concession\n\t\t\t\t\tin respect of, any tax granted to any person by the Government\n\t\t\t\t\tof the former Baroda State by an order issued under the `A'\n\t\t\t\t\tClass Municipalities Act (Baroda Act No. XII of 1949).\"] [(2)] In Section 118,- (i) after sub-section (2) the following shall\n\t\t\t\t\tbe inserted, namely:- \"(2A) It shall be the duty of\n\t\t\t\t\tevery municipality to maintain every regular line of the public\n\t\t\t\t\tstreet prescribed or sanctioned by the Government of the former\n\t\t\t\t\tBaroda State at any time prior to the 30th day of July\n\t\t\t\t\t1949:” Provided that the municipality may alter or\n\t\t\t\t\tcancel any such regular line if having regard to the needs of\n\t\t\t\t\ttraffic- (a) it was before the aforesaid date classified by\n\t\t\t\t\tthe municipality with the sanction of the Government of the\n\t\t\t\t\tformer Baroda State, as unimportant, or (b) it is so\n\t\t\t\t\tclassified by the municipality with the sanction of the State\n\t\t\t\t\tGovernment within two years from the commencement of the Bombay\n\t\t\t\t\tMerged States (Laws) (Second Amendment) Act, 1951 (Bombay XXXII\n\t\t\t\t\tof 1951).\" (ii) in sub-section (3), the following shall\n\t\t\t\t\tbe added at the end, namely:- \"Explanation. -For\n\t\t\t\t\tthe purposes of this section `the regular line of the public\n\t\t\t\t\tstreet' shall include a regular line of public street prescribed\n\t\t\t\t\tor sanctioned by the Government of the former Baroda State at\n\t\t\t\t\tany time prior to the 30th day of July, 1949\".]\n\"4-A. Registration of\n\t\t\t\t\tmedical practitioners registered in merged States. -\n\t\t\t\t\tNotwithstanding anything contained in Section 7, every\n\t\t\t\t\tperson- (a) whose name, immediately before the date of merger\n\t\t\t\t\tof the State with the State of Bombay, stood registered as a\n\t\t\t\t\tmedical practitioner in the register of medical practitioners\n\t\t\t\t\tmaintained under any law for the time being in force in the\n\t\t\t\t\tmerged State; and (b) who holds any of the qualifications\n\t\t\t\t\tspecified in the Schedule to the Indian Medical Council Act,\n\t\t\t\t\t1933 (XXVII of 1933), or this Act, shall be deemed to be a\n\t\t\t\t\tmedical practitioner registered under this Act. (2) If any\n\t\t\t\t\tquestion arises whether any person is deemed to be a registered\n\t\t\t\t\tmedical practitioner under sub-section (1), the matter shall be\n\t\t\t\t\treferred to the Surgeon General with the Government of Bombay\n\t\t\t\t\tfor decision and his decision shall be final.\"\n\"8A. Registration of\n\t\t\t\t\tmedical practitioners registered in merged States.\nThe Bombay Medical Practitioners' Act, 1938\n\t\t\t\t\t(Bombay XXVI of 1938).\nAll merged States\n(1) After Section 17, the following new section\n\t\t\t\t\tshall be inserted, namely:- \"17-A. Registration of\n\t\t\t\t\tpersons registered in merged States. - (1) Notwithstanding\n\t\t\t\t\tanything contained in Section 16, every practitioner, whose name\n\t\t\t\t\timmediately before the date of merger of the State with the\n\t\t\t\t\tState of Bombay, stood registered as a practitioner in the\n\t\t\t\t\tregister of practitioners maintained under any law for the time\n\t\t\t\t\tbeing in force in the merged State corresponding to this Act\n\t\t\t\t\tshall be deemed to be a practitioner registered under this\n\t\t\t\t\tAct. (2) if any question arises whether any person is deemed\n\t\t\t\t\tto be a registered practitioner under subsection (1), the matter\n\t\t\t\t\tshall be referred to the Surgeon General with the Government of\n\t\t\t\t\tBombay for decision and his decision shall be final.\" (2)\n\t\t\t\t\tAfter Section 18, the following new section shall be inserted,\n\t\t\t\t\tnamely:- \"18-1A. Registration of other persons\n\t\t\t\t\tregistered in merged States. - (1) Any person other than the\n\t\t\t\t\tone specified in Section 8-A of the Bombay Medical Act, 1912\n\t\t\t\t\t(Bombay VI of 1912), or Section 17-A of this Act, whose name\n\t\t\t\t\timmediately before the date of the merger of the State with the\n\t\t\t\t\tState of Bombay stood registered in the register maintained\n\t\t\t\t\tunder any law for the time being in force corresponding to\n\t\t\t\t\teither of the aforesaid Acts shall be entered in the list. (2)\n\t\t\t\t\tIf any question arises whether a person is entitled to have his\n\t\t\t\t\tname entered in the list under sub-section (1), the matter shall\n\t\t\t\t\tbe referred to the Surgeon General with the Government of Bombay\n\t\t\t\t\tfor decision and his decision shall be final.\"]\n\"17-A.
