"content": "AN\nACT\nto provide for provincialisation of services of the\nemployees working in the Panchayat of all levels\nestablished under the Assam Panchayat Act, 1994.\nWhereas it is expedient to provide for\nprovincialisation of services of the employees working\nin the Panchayats of all level established under the Assam\nPanchayat Act, 1994, for its improvement and\nfor better management and control of Panchayats in\nthe State of Assam;\nIt is hereby enacted in the Fiftieth Year of the\nRepublic of India as follows :-",

"content": "(2) It shall extend to the whole of Assam in the\nrural areas except the Autonomous Districts under the\nSixth Schedule to the Constitution of India and shall\nexclude any area which has been or hereafter may be\nincluded in a Municipality or a Town Committee or a\nCantonment constituted under the Assam Municipal\nAct, 1956 and the Cantonment Act, 1924,\nrespectively, or by any other Act.",

"content": "4.(1) Notwithstanding anything contained in the preceeding\nsection, all employees other than Grade-IV employees, coming\nwithin the purview of this Act, shall, on attaining the age of 58\nyears, go on superannuation and the Grade-IV employees shall\ngo on superannuation on attaining the age of 60 years.",

"content": "(2) Without prejudice to the generality of the foregoing\nprovision, the State Government may make rules to provide for\nall or any of the following matters, namely :-\n(i) the norms and principles of encadrement of the\nemployees in the appropriate cadre under section 3;\n(ii) manner and principles under which inter-se-seniority of\nthe employees shall be determined under section 3;\n(iii) any other matter which is required to be, or may be\nprescribed.",

"content": "(3) Every rule made under this section shall be laid as soon as\nmay be after it is made, before the Assam Legislative Assembly\nwhile it is in session for a total period of fourteen days which\nmay be comprised in one session or in two successive sessions\nand if before the expiry of the session in which it is so laid or\nthe session immediately following the Assam Legislative\nAssembly agree in making any modification in the rule or the\nAssam Legislative Assembly agree that the rule should not be\nmade, the rule shall thereafter have effect only in such modified\nform or be of no effect as the case may be, so, however, that\nany such modification or annulment shall be without prejudice\nto the validity of anything previously done under that rule.",
