            "content": "Haryana Municipal Inspection & Proper Regulation of Aerated Water, Ice & Ice Cream Factories Bye-laws, 1976\nPublished vide Haryana Government Notification No. GSR 48/../76, dated 19.3.76\nhl423\n1.\nThese bye-laws may be called the Haryana Municipal Inspection and Proper Regulation of Aerated Water, Ice and Ice-Cream Factories Bye-laws, 1976.\n(2) They shall apply to all the municipalities.\n2.\nThe manufacture or preparation for sale of aerated water or ice or ice-cream in any premises not licensed by the committee shall be prohibited.\n3.\nLicencees for such premises shall be granted and be renewable by the committee every year on the 1st day of April on payment of fee as laid down in bye-law 11.\n4.\nNo premises for the manufacture or preparation for sale of ice, ice-cream or aerated waters shall be licensed, unless-\n(a) they have stone, cement or otherwise pucca floor, with three feet cement skirting;\n(b) the walls are properly plastered and lime-washed;\n(c) they are provided with adequate light and ventilation to the satisfaction of the Medical Officer of the committee;\n(d) they are provided with drain and the whole floor sloped so as to allow all liquid to flow off by the drain which must be connected with the municipal sewer;\n(e) there is no direct communication between the premises and any room used as a sleeping or living room;\n(f) the doors, windows and ventilation openings of all premises used for the manufacture of aerated water, ice or ice-cream are rendered fly proof; and\n(g) the water storage tanks are cement lined and kept clean to the satisfaction of the Municipal Medical Officer of Health.\n5.\nNo owner or person in charge of an aerated water, ice, or ice-cream factory shall use or permit to be used in such factory any water except water obtained from the municipal water supply laid in direct pipe connection to such factory, unless special permission to use water from other sources as approved by the Municipal Medical Officer of Health is given by the committee or an officer authorised by it.\n6.\nNo owner or person in charge of an aerated water, ice or ice-cream factory shall employ or permit to be employed in such factory any person suffering from any contagious or infectious disease or from loathsome sores or who has recently been attending on any persons so suffering nor shall permit any such person to enter or remain in such factory.\n7.\nEvery person incharge of an aerated water, ice or ice-cream, factory shall keep such factory and all vessels, receptacles, utensils and other things in which the products of the factory or the material used in making them are kept in a state of thorough cleanliness.\n8.\nEvery person or owner incharge of an aerated water, ice or ice-cream factory shall permit the Municipal Medical Officer of Health and any member or other officer of the committee appointed in this behalf to inspect such factory at all reasonable times, and he shall abide by any reasonable rules laid down by the committee from time to time.\n9.\nEvery person employed in the manufacture of aeraed water, ice or ice-cream must be cleanly and properly dressed.\n10.\nIf, at any time, the water is found unfit for human consumption, the District Magistrate on the recommendations of Health authorities, order the closure of the ice, ice-cream or aerated water factory till it is declared fit.\n11.\nA fee at the following rates shall be levied and paid for the issue of a licence under these bye-laws for ice, ice-cream and aerated water factories :-\nRs. Per annum\n(1) Ice or ice-cream or aerated water factories with turnover\n\t\t\tof Rs. 20,000 per annum or below\n.... 100\n(2) Ice or ice-cream or aerated water factories with turnover\n\t\t\tabove Rs. 20,000 per annum\n.... 500\n12.\nAny person who commits, or abets the commission of, a breach of any of these bye-laws shall, on conviction by a magistrate, be punishable with a fine which shall not be less than twenty-five rupees and more than two hundred rupees and if the breach is a continuing breach, with a further fine of ten rupees for every day after the first during which the breach continues.\n13.\nAll bye-laws relating to aerated water, ice, ice-cream factories inforce in the municipalities immediately before the commencement of these bye-laws shall stand repealed:\nProvided that any order made or action taken under the bye-laws so repealed shall be deemed to have been made or taken under the corresponding provisions of these bye-laws.",
