Amendment of Section\r\nTo sub-section (2) of Section 37, following proviso shall be deemed to be added, namely :--\r\n\"Provided that no Court shall take cognizance of an offence punishable under sub-section (1) of Section 38, as substituted by Section 12 of the Chhattishgarh Ashaskiya Shikshan Sanstha ¹[Anudan Ka Pradaya] Adhiniyam, 1978 except upon a complaint made by such officer as the State Government may, by notification, specify in this behalf.\"\r\n\r\n4. Amendment of Section\r\nFor sub-section (1) of Section 38, the following Section shall be deemed to be substituted, namely:--\r\n\"(1) If the President, Secretary or any other person authorised in this behalf by a resolution of the governing body of the society.\r\n(a) fails to comply with the provisions of Section 27; ??\r\n(b) fails to comply with any direction given under Section 4 or with the provisions of Section 3 or Section 5 or Section 6 of the Chhattishgarh Ashaskiya Shikshan Sanstha ¹[Anudan Ka Pradaya] Adhiniyam, 1978\r\nhe shall, on conviction be punishable--\r\n(i) ²[* * *] with the fine which may extend to five hundred rupees and in the case of a continuing breach with a further fine which may extend to fifty rupees for every day after the first, during which the breach continues;\r\n(ii) ²[*]\"",
