            "title": "Section 3. Establishment and Incorporation of the University",

            "content": "(1)(i) A University by the name of Bihar Animal Sciences University shall be established for the State of Bihar with effect from such date as the State Government may, by notification in the Official Gazette, appoint.",

            "title": "Section 3(1)(ii)",

            "content": "(ii) All colleges, research and experimental stations, animal science centres or other institutions mentioned in the Appendix shall be constituent units of the University under the full management and control of its officers and authorities, and no such unit shall be recognized as an affiliated unit. The State Government shall have the power to add to or delete from the Appendix any institution.",

            "title": "Section 3(2)",

            "content": "(2) The University shall consist of the Chancellor, Vice-Chancellor, Board of Management, Academic Council and other authorities and officers and constituent bodies as provided in this Act or Statutes.",

            "content": "(3) The University shall, subject to the provisions of this Act, be a body corporate having perpetual succession and a common seal, and shall sue and be sued by the said name.",

            "title": "Section 3(4)",

            "content": "(4) The University shall be competent to acquire and hold both movable and immovable property, to lease, sell or otherwise transfer any movable and immovable property which may have become vested in or been acquired by it for the purposes of the University and to receive grants from the Central Government, State Government or any corporate body approved by the State Government, borrow money and enter into contracts and do all other acts necessary for the purposes of this Act:\nProvided that the University shall not lease, sell or otherwise transfer any immovable property transferred to it by the State Government without the prior approval of the State Government.",

            "title": "Section 4. Territorial Jurisdiction",

            "content": "(1) With respect to the functions of teaching, research and extension education at the university and college levels related to Veterinary and Animal Sciences as defined in this Act, the territorial jurisdiction and responsibility of this University shall extend to the whole of the State of Bihar.",

            "title": "Section 4(2)",

            "content": "(2) The University may establish, operate, maintain and develop Teaching Centres, Educational Centres, Research and Experimental Centres, and Extension Education Training Centres in the field of Veterinary, Animal Husbandry, Fishery, Poultry, Dairy Technology and allied subjects as may be required in various parts of the State, and shall be responsible for its management, development and operations.",

            "title": "Section 5. Objectives of the University",
            "chapter": null,
            "content": "The following are the objectives of the University :-\n(i) To make arrangement for giving education in different branches of study, particularly Veterinary Science & Animal Husbandry, Poultry, Fisheries, Dairy and other allied branches of learning and scholarship;\n(ii) To further the advancement of learning and conducting of research, particularly in Veterinary & Animal Sciences and other allied sciences;\n(iii) To undertake the extension of education of such sciences and technologies that are relevant for the rural people of the State;\n(iv) To facilitate and ensure qualitative improvement in the teaching and learning processes and methodology;\n(v) To facilitate and ensure quality research in the contemporary and frontier areas of animal science and technologies;\n(vi) To facilitate the need for an organized process of life long learning;\n(vii) To disseminate knowledge and findings emerging in the University, its colleges, and institutions;\n(viii) To establish partnerships with the industries and other entities working in animal science and technology and agriculture manufacturing;\n(ix) To establish Hospital for treatment/ research-role of the University.\n(x) Such other purposes as the University or Government may from time to time determine.",

            "title": "Section 6. Admission to the University",

            "content": "(1) The University shall, subject to the provisions of this Act and the statutes, be open to all persons irrespective of caste, race, religions or class.\nProvided that nothing in this section shall require the University to admit to any course of study any person who does not meet the prescribed academic standards for admission or to retain on the rolls of the University persons whose academic records are below the minimum standard required for the award of a degree or whose personal conduct is such as to be inimical to the purpose of the University or to the appropriate rights and privileges of other students and staffs: Provided further that nothing in this section shall be deemed to require the University to admit to any course of study larger number of students than can be accommodated in the available faculties of the University or of any particular college or Department as determined by the Academic Council.",

            "title": "Section 7. Powers and Functions of the University",

            "content": "The University shall have the following powers and functions :-\n(i) to provide for undergraduate and postgraduate instruction in Veterinary, Animal Sciences & Technology and other allied subjects as the University may deem fit;\n(ii) to provide for conducting research in Veterinary, Animal Sciences & Technology and its allied branches;\n(iii) to provide for dissemination of research findings and technical information through extension education programmes;\n(iv) to institute courses of study and hold examinations and confer degrees, diplomas and other academic distinctions on persons who have pursued a prescribed course of study or research or both, including partial courses or research in other universities or recognized institutions for this purpose;\n(v) to confer honorary degrees and other distinctions as prescribed and to withdraw any such degree or academic distinction for good and sufficient reason;\n(vi) to provide training for field personnel, rural popular representatives and other persons who are not enrolled as regular students;\n(vii) to work in cooperation with other universities and institutions within the limits prescribed in subsection (4) of section 4;\n(viii) to establish and maintain colleges, faculties, centres and departments related to Veterinary Science, Animal Husbandry, Fisheries, Dairy Technology, Poultry and other allied sciences;\n(ix) to establish and maintain laboratories, veterinary clinics, agricultural farms, libraries, research centres, institutes and museums for teaching, research and extension education;\n(x) to create teaching, research and extension education posts with the prior approval of the State Government and to appoint qualified persons to such posts;\n(xi) to create administrative and other posts with the prior approval of the State Government and to appoint competent persons to such posts;\n(xii) to institute and award fellowships, scholarships, stipends and prizes in accordance with the Statutes;",

            "title": "Section 7(xiii)",

            "content": "(xiii) to institute and maintain residential accommodation for students and employees of the University;\n(xiv) to fix and receive fees and other charges as may be prescribed;\n(xv) to supervise and control the residence, conduct and discipline of students of the University and to make arrangements for promoting their health and welfare;\n(xvi) to appoint visiting professors, emeritus professors, consultants, scholars and such other persons on contract or otherwise who can contribute to further the objectives of the University;\n(x7) to determine the service conditions of all categories of University employees including their code of conduct;\n(xviii) to decide the standards for admission, examination, evaluation or any other method of testing for the University and its constituent colleges;\n(xix) to receive benefactions, donations and gifts and to acquire, possess, manage and transfer movable or immovable properties including trusts and endowments:\nProvided that no immovable property shall be transferred without the prior approval of the State Government;\n(xx) to borrow or lend with the permission of the Board of Management and to borrow money for the purposes of the University by pledging the property of the University with the prior permission of the State Government;\n(xxi) to initiate measures to enlist the cooperation of industries and government for supplementary facilities;\n(xxii) to enhance entrepreneurship capability among its teachers and students;\n(xxiii) to educate the public in keeping with opportunities in the profession of animal science and technology;\n(xxiv) to do all such acts, whether incidental to the illustrative powers aforesaid or not, as may be requisite in order to further the objectives of the University.",

            "title": "Section 8. Powers and Functions of the Chancellor",

            "content": "The Chancellor shall have the following powers and functions :-\n(i) The Governor of Bihar shall be the ex-officio Chancellor of the University.\n(ii) The Chancellor, when present, shall preside over the convocation of the University.\n(iii) Awards, honorary degrees and privileges shall be conferred after the approval of the Chancellor.\n(iv) Without prejudice to the other provisions of this section, the Chancellor may, by order in writing, annul any order or proceeding of any officer or authority of the University which is not in conformity with this Act and the Statutes or Ordinances made thereunder:\nProvided that before making any such order, the Chancellor shall call upon the concerned officer or authority of the University to show cause why such an order should not be passed, and if any reasonable cause is shown within the specified time limit, the Chancellor shall consider the same;\n(v) The Chancellor shall have such other powers as may be prescribed by the Act or Statutes.\n(vi) The Chancellor shall have the right to cause an inspection to be made, by such person or persons as he may direct, of the University, its buildings, laboratories, libraries, museums, workshops, farms and equipment, hostels and institutions maintained or managed by the University, and of the teaching and other work conducted by the University or under its auspices, and to cause an inquiry to be made in respect of any matter connected with the administration and financial affairs of the University.",

            "title": "Section 8(vii)",
            "chapter": null,
            "content": "(vii) The Chancellor shall, in every case, give notice to the University or Board of his intention to cause an inspection or inquiry to be made and the University or Board, as the case may be, shall on receipt of such notice have the right to make such representation to the Chancellor as it may think fit within the period specified in the notice.\n(viii) After considering the representation (if any) made by the University or Board or any other institution, the Chancellor may cause the inspection or inquiry specified in subsection (1) to be made.\n(ix) Where an inspection or inquiry has been caused to be made by the Chancellor, the University or Board shall be entitled to appoint a representative who shall have the right to be present and be heard at such inspection or inquiry.\n(x) The Chancellor shall communicate to the University or its Board the report of such inspection or inquiry and his views thereon and his advice as to the action to be taken, and after obtaining the opinion of the University thereon, may fix a time limit and advise or direct the University to take necessary action.\n(xi) The University shall, within the time limit so fixed, inform the Chancellor of the action taken or proposed to be taken upon his advice.\n(xii) Where the University does not take action within the fixed time limit to the satisfaction of the Chancellor, the Chancellor may, after considering any explanation furnished or representation made by the University, issue such directions as he may think fit and the University shall comply with those directions.\n(xiii) Notwithstanding anything contained in the preceding subsections of this section, if at any time the Chancellor is of the opinion that the affairs of the University are not being conducted properly or in the light of the Act, Statutes, Ordinances or Regulations, or that special efforts are not being made for the teaching work, examination, research or extension work of the University, he may call upon the University to show cause within a specified time limit. If the University fails to furnish its explanation within the specified time limit or if its explanation is in the opinion of the Chancellor not satisfactory, the Chancellor may issue such directions as appear to him necessary and desirable in the circumstances of the case and exercise his powers to make those instructions effective.\n(xiv) The University shall submit such information relating to its administration to the Chancellor as may be required by him.",

            "title": "Section 9. Authorities of the University",

            "content": "(2) Without prejudice to the generality of the foregoing powers under subsection (1), the Board shall exercise the following powers and perform the following functions :-\n(i) to consider and approve the financial requirements, estimates and budget for the University;\n(ii) to hold and control the property and funds of the University and to issue any general directions on behalf of the University;\n(iii) to accept or transfer any property on behalf of the University;\n(iv) to administer funds placed at the disposal of the University for specific purposes;\n(v) to arrange for the investment and withdrawal of funds of the University;\n(vi) to borrow money for capital investment with the prior approval of the State Government and to make proper arrangements for its repayment;\n(vii) to accept trusts, bequests and donations on behalf of the University;\n(viii) to consider and approve the recommendations of the Academic, Research and Extension Education Councils wherever required;\n(ix) to direct the form and use of the common seal of the University;\n(x) to constitute committees and bodies as necessary and to determine the terms of reference for them in accordance with the provisions of this Act and Statutes;\n(xi) to establish or consider and approve the abolition of a college, department, centre or research centre/sub-centre on the recommendation of the Academic Council, or to reorganize a department or research centre on the recommendation of the Academic Council;\n(xii) to consider and approve the establishment of a new college or faculty, amalgamation of two or more colleges or faculties, or abolition of a college or faculty on the recommendation of the Academic Council;\n(xiii) to approve recommendations for the appointment of officers/office-bearers and teachers of the University;\n(xiv) to create various posts in the University and its colleges, centres and institutions;\n(xv) to perform such other functions as may be assigned to it by the Statutes.",
