"content": "An Act for the protection of the right of fishing\nin private waters.\nWHEREAS it is expedient to provide for the pro-\ntection of private rights of fishery;\nAnd whereas the previous sanction of the\nGovernor General has been obtained under\nsub-section (3) of section 80A of the Government of\nIndia Act to the passing of this Act.\nIt is hereby enacted as follows:-",

Any person who-\n(a) fishes in any private waters, not having\na right to fish therein;\n(b) erects, places, maintains or uses any fixed\nengine in private waters, or puts, or\nknowingly permits to be put therein\nany matter for the purpose of catching\nor destroying fish without the permis-\nsion of the person to whom the right\nof fishery therein belongs;\nshall be guilty of an offence, and shall be\npunished for a first offence with a fine not\nexceeding fifty rupees;\nand for a subsequent offence with imprisonment,\nwhich may be simple or rigorous for a term not\nexceeding one month, or with a fine not exceed-\ning two hundred rupees or both:\nProvided that nothing herein contained shall\napply to acts done by any person in the exercise\nof a bona fide claim of right, or in accordance with\na long-established custom or shall prevent any\nperson from angling with a rod and line or with\na line only in any portion of a navigable river.",
